On November 23, 2022, the General Court of the European Union published a summary of its judgment in the Official Journal. According to the document, the EU General Court ruled in CWS Powder Coatings and Others v. Commission that the European Commission made a clear error in classifying titanium dioxide as a carcinogenic chemical; unless the judgment is appealed to the Court of Justice of the European Union, the classification behavior will be abolished. This will mean that products containing titanium dioxide will no longer need to be labeled as a carcinogen.
Regulation (EU) 2020/217 issued by the European Commission lists titanium dioxide as a second category of inhaled carcinogens. Therefore, liquid mixtures containing 1% or more titanium dioxide particles with an aerodynamic diameter of 10 microns or less must bear the following package label: "Warning! May form hazardous respirable droplets when sprayed. Do not breathe spray or fog". Likewise, the label "Warning! Use may form hazardous respirable dust. Do not breathe dust" must accompany products containing 1% or more titanium dioxide solid mixtures.
The EU classifies titanium dioxide according to the opinions of the European Chemicals Agency (ECHA). This is based on a scientific study that found that titanium dioxide overloads the lungs and is therefore carcinogenic. The General Court found both parts of this conclusion to be problematic and therefore annulled Regulation 2020/2017.
